Suit against Wamakko’s candidature struck out

The Federal High Court sitting in Abuja yesterday struck out a suit challenging the candidature of Sokoto State Governor Alhaji Aliyu Wamakko of the Peoples Democratic Party candidate who won the re- run governorship election in the state this year.
Alhaji Mohammed Dingyadi of the All Nigeria Peoples Party [ANPP] had filed the suit after Governor Wamakko whose election of April, 2007 was nullified by the Court of Appeal in Kaduna was fielded by the PDP for the re-run election.
The Court of Appeal, “in the lead judgment delivered by Justice Ahmed Belgore on 11th April 2008 had stated that Wamakko was not qualified to contest the April 14th,  2007 gubernatorial .election on the platform of the PDP because as at when he was nominated by the PDP, he was still a member of the All Nigerian  Peoples Party [ANPP] which had also nominated him as their gubernatorial candidate”. 
Ruling on Alhaji Dingyadi’s suit which sought the court order and declaration that Wamakko was not qualify to contest the re-run election haven being disqualified by the Court of Appeal for the April , 2007 governorship election in question, the trial judge, Justice Adamu Bello said the Federal High Court has no power to grant the prayer of the plaintiff. 
He held that the prayer would lead the court to interpret, review and construct the judgment of the Court of Appeal delivered on 11th April, 2008 which nullified Wamakko’s election. 
“The matter of this plaintiff is dangerous invitation to this court to do just that which I am not prepare to honour as doing it will lead to chaos and confusion,.’’ the judge further stated.  
He said it would be ridiculous for this court to venture into granting the prayers of the plaintiff which touches on the judgment of the Court of Appeal that is so clear an unambiguous. “The case is incompetent and is hereby strike out”, he added.
